This debate is essential if we are to understand what is really at stake behind these treaties.<\/em><\/p>\n<p id=\"ember1647\" class=\"ember-view reader-text-block__paragraph\">The debate on the future institutional agreements between Switzerland and the European Union regularly rears its head in the public arena. Presented by their supporters as a simple \u00abstabilisation mechanism\u00bb for bilateral relations, these treaties would in fact entail a profound change in the legal and political structure of the Confederation.<\/p>\n<p id=\"ember1648\" class=\"ember-view reader-text-block__paragraph\">A recent debate published by the <strong>Neue Z\u00fcrcher Zeitung (NZZ) of 27 February 2026<\/strong> highlights the scale of these issues. Two legal experts compare their analyses: <strong>Martin Dumermuth<\/strong>, a former senior official in the Federal Department of Justice who was in favour of the agreements, and <strong>Paul Richli<\/strong>, former Rector of the University of Lucerne and a specialist in public law, who is firmly opposed to the idea.<\/p>\n<p id=\"ember1649\" class=\"ember-view reader-text-block__paragraph\">Paul Richli's warnings deserve particular attention. They accurately describe the institutional consequences of such a system.<\/p>\n<h3 id=\"ember1650\" class=\"ember-view reader-text-block__heading-3\">A major transfer of legal power<\/h3>\n<p id=\"ember1651\" class=\"ember-view reader-text-block__paragraph\">According to Paul Richli, the adoption of a\u2019<strong>dynamic alignment with European law<\/strong> would constitute a fundamental break in the Swiss constitutional order.<\/p>\n<p id=\"ember1652\" class=\"ember-view reader-text-block__paragraph\">As he explains:<\/p>\n<blockquote id=\"ember1653\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abAdopting European law would have enormous consequences. The Federal Council is playing down the consequences.\u00bb<\/p><\/blockquote>\n<p id=\"ember1654\" class=\"ember-view reader-text-block__paragraph\">The central problem lies in the very logic of the system. European standards are constantly evolving. A dynamic alignment mechanism would mean that Switzerland would have to adapt its domestic law to these developments, often without direct participation in the decision-making process.<\/p>\n<p id=\"ember1655\" class=\"ember-view reader-text-block__paragraph\">Richli stresses that this development would profoundly transform the way the Swiss political system works:<\/p>\n<blockquote id=\"ember1656\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abParliament would abdicate its role. There would be no more consultation process. The business community would lose all means of influencing Parliament; it would have to lobby Brussels directly.\u00bb<\/p><\/blockquote>\n<p id=\"ember1657\" class=\"ember-view reader-text-block__paragraph\">In other words, a large part of the normative production would no longer go through the traditional Swiss institutions - consultation, parliamentary debates and, ultimately, direct democracy.<\/p>\n<h3 id=\"ember1658\" class=\"ember-view reader-text-block__heading-3\">The illusion of Swiss influence in Brussels<\/h3>\n<p id=\"ember1659\" class=\"ember-view reader-text-block__paragraph\">Some supporters of the agreements maintain that Switzerland could still exert an informal influence on European legislation.<\/p>\n<p id=\"ember1660\" class=\"ember-view reader-text-block__paragraph\">For Richli, this idea is largely an illusion.<\/p>\n<p id=\"ember1661\" class=\"ember-view reader-text-block__paragraph\">He draws particular attention to the example of the\u2019<strong>European Economic Area (EEA)<\/strong> :<\/p>\n<blockquote id=\"ember1662\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abThe example of the EEA Member States, which have virtually no decision-making powers, demonstrates this.\u00bb<\/p><\/blockquote>\n<p id=\"ember1663\" class=\"ember-view reader-text-block__paragraph\">These countries have to adopt a large part of European law without really participating in its design. Switzerland would run the risk of finding itself in a similar situation: applying standards decided elsewhere.<\/p>\n<h3 id=\"ember1664\" class=\"ember-view reader-text-block__heading-3\">The \u00abcompensatory measures\u00bb mechanism\u00bb<\/h3>\n<p id=\"ember1665\" class=\"ember-view reader-text-block__paragraph\">Another particularly sensitive issue concerns <strong>compensatory measures<\/strong> that the European Union could impose in the event of divergence.<\/p>\n<p id=\"ember1666\" class=\"ember-view reader-text-block__paragraph\">Richli describes a legally asymmetrical system:<\/p>\n<blockquote id=\"ember1667\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abThe EU could impose offsets in any area, even unrelated ones, such as medical or food products.\u00bb<\/p><\/blockquote>\n<p id=\"ember1668\" class=\"ember-view reader-text-block__paragraph\">This logic creates permanent uncertainty:<\/p>\n<blockquote id=\"ember1669\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abSwitzerland does not know where the EU will intervene. No one wants to take the risk of being affected by an unknown compensatory measure.\u00bb<\/p><\/blockquote>\n<p id=\"ember1670\" class=\"ember-view reader-text-block__paragraph\">Under such a system, political and economic pressure would provide a strong incentive for Switzerland to accept the requested adjustments, even in the event of disagreement.<\/p>\n<h3 id=\"ember1671\" class=\"ember-view reader-text-block__heading-3\">The uncertain role of the arbitral tribunal<\/h3>\n<p id=\"ember1672\" class=\"ember-view reader-text-block__paragraph\">The draft agreements provide for a dispute settlement mechanism based on an arbitration tribunal.<\/p>\n<p id=\"ember1673\" class=\"ember-view reader-text-block__paragraph\">But Richli wonders how it really works:<\/p>\n<blockquote id=\"ember1674\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abHow is the arbitral tribunal supposed to determine whether extrajudicial measures are proportionate?\u00bb<\/p><\/blockquote>\n<p id=\"ember1675\" class=\"ember-view reader-text-block__paragraph\">It also highlights the decisive importance of the personalities appointed:<\/p>\n<blockquote id=\"ember1676\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abA lot will depend on who is elected to the arbitration tribunal and whether they can truly represent our interests.\u00bb<\/p><\/blockquote>\n<p id=\"ember1677\" class=\"ember-view reader-text-block__paragraph\">As a warning, he refers to the experience of the Swiss judge at the <strong>European Court of Human Rights<\/strong>, which has sometimes voted against the Swiss position.<\/p>\n<h3 id=\"ember1678\" class=\"ember-view reader-text-block__heading-3\">Growing pressure to integrate<\/h3>\n<p id=\"ember1679\" class=\"ember-view reader-text-block__paragraph\">Richli also believes that these agreements would not constitute lasting stabilisation, but rather a step towards gradual integration.<\/p>\n<p id=\"ember1680\" class=\"ember-view reader-text-block__paragraph\">He states:<\/p>\n<blockquote id=\"ember1681\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abIt is likely that the EU will soon exert additional pressure on Switzerland to adopt dynamic legislation in other areas, such as the free trade agreement.\u00bb<\/p><\/blockquote>\n<p id=\"ember1682\" class=\"ember-view reader-text-block__paragraph\">In his view, Brussels' strategic objective is clear: to avoid having to renegotiate regularly with Switzerland and gradually integrate its legal framework into that of the EU.<\/p>\n<h3 id=\"ember1683\" class=\"ember-view reader-text-block__heading-3\">The example of current trade tensions<\/h3>\n<p id=\"ember1684\" class=\"ember-view reader-text-block__paragraph\">Richli also points out that economic tensions already exist, despite the current agreements.<\/p>\n<p id=\"ember1685\" class=\"ember-view reader-text-block__paragraph\">In particular, he cites European pressure on certain industrial sectors:<\/p>\n<blockquote id=\"ember1686\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abWe are currently seeing how the EU wants to impose customs duties on Swiss steel specialities. This is a flagrant violation of the free trade agreement.\u00bb<\/p><\/blockquote>\n<p id=\"ember1687\" class=\"ember-view reader-text-block__paragraph\">In other words, even within the current framework, relations are still marked by recurring trade conflicts.<\/p>\n<h3 id=\"ember1688\" class=\"ember-view reader-text-block__heading-3\">The decisive point: irreversibility<\/h3>\n<p id=\"ember1689\" class=\"ember-view reader-text-block__paragraph\">But Richli's central warning concerns the <strong>irreversible dimension<\/strong> of these agreements.<\/p>\n<p id=\"ember1690\" class=\"ember-view reader-text-block__paragraph\">It sums up this reality in no uncertain terms:<\/p>\n<blockquote id=\"ember1691\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abWe need to be aware of this: if we conclude these agreements, it will be virtually impossible to turn back the clock.\u00bb<\/p><\/blockquote>\n<p id=\"ember1692\" class=\"ember-view reader-text-block__paragraph\">In a system where a large part of the law would be progressively aligned with that of the European Union, an exit would become politically and legally extremely complex.<\/p>\n<h3 id=\"ember1693\" class=\"ember-view reader-text-block__heading-3\">Conclusion - The fundamental question: who decides in Switzerland?<\/h3>\n<p id=\"ember1694\" class=\"ember-view reader-text-block__paragraph\">Basically, the debate goes far beyond the simple technical management of relations with the European Union.<\/p>\n<p id=\"ember1695\" class=\"ember-view reader-text-block__paragraph\">The central question is institutional: <strong>Who decides which law applies in Switzerland?<\/strong><\/p>\n<p id=\"ember1696\" class=\"ember-view reader-text-block__paragraph\">The Swiss model has been based on a particular balance for centuries:<\/p>\n<p id=\"ember1697\" class=\"ember-view reader-text-block__paragraph\">Confederation, cantons, economic consultation, direct democracy and parliamentary accountability.<\/p>\n<p id=\"ember1698\" class=\"ember-view reader-text-block__paragraph\">If an increasing proportion of legislation comes from an external legal order, this balance changes mechanically.<\/p>\n<p id=\"ember1699\" class=\"ember-view reader-text-block__paragraph\">As Paul Richli sums up in the interview published by the <strong>NZZ (27 February 2026)<\/strong> :<\/p>\n<blockquote id=\"ember1700\" class=\"ember-view reader-text-block__blockquote\"><p>\u00abWe are naive to believe that we would not lose significant powers.\u00bb<\/p><\/blockquote>\n<p id=\"ember1701\" class=\"ember-view reader-text-block__paragraph\">In other words, behind the diplomatic language of \u00abinstitutional agreements\u00bb lies a much more fundamental issue: <strong>Switzerland's ability to remain master of its own law.<\/strong><\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Et si la question n\u2019\u00e9tait plus \u00e9conomique, mais institutionnelle ?
